Terms of Service

The agreement between you and Andre Schweighofer when you use tidaltree.

1. What tidaltree is

tidaltree is a self-paced digital toolkit that helps new breathwork practitioners find and keep their first paying clients. It provides a list of your people with ready-made messages, a pricing tool, a public page, and templates. It is a tool, not professional advice. What tidaltree deliberately does not do is listed on our non-goals page: it does not provide legal, medical, tax, insurance, or business-registration advice, and it does not process your clients' payments.

2. Your account

Access is personal to you. Sign-in is by emailed link. Keep access to your email secure. Direct purchases grant a single seat for one person. School-provided seats are granted and paid for by your school.

3. Price and payment

Prices are shown before purchase. Direct access is a one-time payment, with no subscription. "Lifetime access" means for as long as we run tidaltree. If we ever close it, we'll email you at least 90 days ahead and send you a copy of your data if you ask. Payment is handled by Polar (Polar Software, Inc.), our reseller and merchant of record, who is the seller of record and issues your invoice.

4. Right of withdrawal (Widerrufsrecht)

If you buy as a consumer, you can withdraw within 14 days of your purchase, even after you've started using tidaltree. Email us from the address you bought with and we'll refund you in full. This is also our 14-day money-back guarantee, so no reason is needed.

5. What you may and may not do

The drafts and templates are yours to adapt and use in your own practice. You may not resell, redistribute, or publish tidaltree's content as your own product. You are responsible for adapting templates (including the health screen and consent form) to your jurisdiction and having them reviewed where needed.

6. What you publish

Your page, your testimonials and your messages are yours, and so is the responsibility for them. Publish only words your clients actually said and agreed to share. Don't claim that breathwork treats or cures an illness; the rules on health claims differ by country, and following them is up to you. We may take a page offline if it breaks the law or these terms, and we'll tell you why.

7. Your people's details

You decide whom you add and why, so you are the controller of your people's details and we process them for you. We use them only to run tidaltree for you, keep them confidential, and apply the security measures, subprocessors and safeguards set out in our Data Processing Agreement, which apply to your people the same way they apply to a school's graduates. We never contact them, and we delete them when you delete them or your account.

8. Liability

tidaltree is provided as-is. To the extent permitted by law, we are not liable for how you run your practice, for the safety of sessions you deliver, or for indirect or consequential loss. Mandatory statutory liability (including for intent, gross negligence, and personal injury) is unaffected.

9. Ending access

You can stop using tidaltree at any time and ask us to delete your account. We may suspend access for misuse, or where a purchase is refunded or charged back.

10. Governing law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of your country of residence are unaffected.
